Scrap Metal Relevant Offences and Relevant Enforcement ActionThe Scrap Metal Dealers Act 2013 (Prescribed Relevant Offences and Relevant Enforcement Action) Regulations 2013 has been published to come into force on the 1st of October 2013 when the act is due to also commence.


Section 3(1) of the 2013 Act states that Council’s must not issue a licence unless it is satisfied that the applicant is a suitable person to carry on business as a scrap metal dealer.


Subsection 2 states that in determining whether the applicant is a suitable person, Council’s may have regard to any information which it considers to be relevant.  Such information includes amongst others:



  • whether the applicant or any site manager has been convicted of any relevant offence;

  • whether the applicant or any site manager has been the subject of any relevant enforcement action.

The relevant offences and relevant enforcement action regulations outline the offences and enforcement actions that Council may take into account when determining applications.
